Gull Meadow Farms

The purpose of this Agreement is to promote a safe and enjoyable experience for all guests while acknowledging the inherent risks associated with visiting a working farm and participating in agritourism and recreational activities.

By entering Gull Meadow Farms or participating in any activity on the property, each participant acknowledges that outdoor farm activities involve risks that cannot be completely eliminated. By signing this Agreement, you voluntarily assume those risks and agree to the terms outlined below. This Agreement applies to all participants, whether they purchase admission, attend a special event, accompany another guest, or otherwise enter the property.

Definitions

“Gull Meadow Farms,” “the Farm,” or “GMF” means Gull Meadow Farms and its owners, officers, directors, employees, volunteers, contractors, agents, affiliates, insurers, vendors, sponsors, landowners, successors, and assigns.

“Participant” means every individual entering or using the property, regardless of age or whether they actively participate in attractions or activities.

“Parent or Guardian” means any parent, legal guardian, or other individual who has the legal authority to sign this Agreement on behalf of a minor participant.

“Premises” means all property owned, leased, operated, or controlled by Gull Meadow Farms, including parking areas, walking paths, fields, orchards, attractions, buildings, retail areas, food and beverage areas, event spaces, restrooms, transportation areas, and any other location accessible to guests.

“Activities” means all attractions, transportation, demonstrations, exhibits, seasonal events, recreational activities, services, and amenities offered by Gull Meadow Farms, whether specifically listed in this Agreement or added in the future.

This Agreement applies to participation in, observation of, or presence at any attraction, activity, transportation service, event, or facility located on the premises of Gull Meadow Farms — including the full range of farm attractions described in Section 7 below, as well as any future attractions or seasonal experiences.

Transportation

This Agreement also applies to transportation provided by Gull Meadow Farms, including wagon rides, tractor-pulled wagons, the Pumpkin Lane Train, transportation to and from seasonal attractions such as the sunflower fields, and any future transportation services.

General Farm Areas

This Agreement applies while on any portion of the Farm's property, including parking lots, sidewalks and walking paths, fields, orchards, food and beverage areas, the Farm Market, bakery, picnic areas, restrooms, party areas, event tents, queue lines, waiting areas, entry and exit areas, and any other area accessible to guests — whether supervised by staff or self-guided.

As a participant, I agree to:

1. Follow all posted signs, safety rules, warnings, and verbal instructions from staff.
2. Participate only in activities I meet the posted age, height, weight, health, or other requirements for.
3. Use attractions, equipment, and facilities only as intended.
4. Exercise reasonable care for my own safety and the safety of others.
5. Refrain from reckless, unsafe, or disruptive behavior.
6. Stay within designated guest areas and respect barriers, fences, gates, and restricted areas.
7. Wear clothing and footwear suitable for outdoor farm conditions.
8. Immediately notify staff of any unsafe condition, accident, injury, or emergency.
9. Take responsibility for deciding whether I'm physically capable of participating in an activity.
10. Understand that participation is voluntary — I can opt out if I believe conditions are unsafe.

Failure to follow posted rules or staff instructions may result in removal from an attraction or from Gull Meadow Farms without refund.

Parents & guardians

A parent or legal guardian signing on behalf of a minor represents that they have the legal authority to do so. GMF is not responsible for supervising children. Parents and guardians agree to closely supervise minors at all times, ensure they follow posted rules and staff instructions, judge whether each child is capable of participating in an activity, keep children out of restricted areas, and accept responsibility for their conduct on the Farm.

By participating, I represent that, to the best of my knowledge: I am physically able to participate in the activities I choose; I don't have a medical condition that would make participation unsafe; I'm not participating against a physician's advice; and I will not participate under the influence of alcohol, illegal drugs, or any medication that could impair my judgment, coordination, or ability to participate safely. GMF does not evaluate participants for medical fitness and relies on each participant's own judgment.

Gull Meadow Farms is an active working farm offering outdoor recreational and agritourism activities. Participation involves inherent and unavoidable risks that can't be eliminated without fundamentally changing the experience — arising from natural conditions, other participants, equipment, animals, weather, and other circumstances that may not always be foreseeable. These risks include, but are not limited to:

Outdoor conditions

Uneven terrain, grass, gravel, dirt, mud, rocks, roots, holes, slopes and hills, wet or slippery surfaces, dust and pollen, changing weather, rain, wind, heat, cold, lightning, and reduced visibility during evening events.

Farm environment

Farm equipment, tractors, wagons, trailers, utility vehicles, excavators, moving vehicles, fencing, gates, agricultural operations, and natural obstacles.

Attractions

Activities involving climbing, jumping, sliding, swinging, balancing, riding, crawling, lifting, pulling, shooting, or transportation carry inherent risks including falls, collisions, loss of balance, and equipment-related injuries. Attractions include, but are not limited to:

Animals

Interactions with farm animals involve inherent risks. Animals may behave unpredictably despite proper care and may scratch, bite, kick, step on, bump into, or otherwise injure participants. There are also risks from allergies, insects, animal feed, and naturally occurring bacteria or diseases in agricultural environments.

Food & beverage

GMF offers food, beverages, cider, and, during certain events, wine. I accept responsibility for food allergies, dietary restrictions, or reactions. I understand alcohol may impair judgment and coordination, agree not to participate in attractions if impaired, and accept full responsibility for my consumption and resulting actions.

Other guests

GMF cannot control every visitor's actions, and injuries may occur due to other participants' behavior. These examples aren't a complete list of every possible risk. I voluntarily choose to participate despite these known and unknown risks and knowingly assume full responsibility for any resulting injury, illness, property damage, disability, emotional distress, or death.

To the fullest extent permitted by applicable law, I — on behalf of myself and any minor participant I have legal authority to sign for — voluntarily release, waive, discharge, and agree not to sue Gull Meadow Farms for any claims, damages, losses, or expenses arising from my presence on the Farm or participation in any activities. This includes claims for personal injury, illness, property damage, emotional distress, disability, or wrongful death arising from GMF's ordinary negligence, to the fullest extent permitted under Michigan law.

This release does not apply to claims that can't legally be waived, including gross negligence or willful or wanton misconduct. I understand I'm giving up substantial legal rights by signing.

I also agree to indemnify, defend, and hold harmless Gull Meadow Farms against claims arising from my own actions, my failure to follow posted rules, damage I cause to Farm property, or claims brought on behalf of a minor resulting from my failure to properly supervise or my lack of authority to sign for them — to the extent permitted by law.

GMF provides opportunities to observe, pet, and feed farm animals. I understand animals, regardless of training or temperament, may behave unpredictably and could scratch, bite, kick, head-butt, step on, or otherwise injure participants without warning, and that interaction may expose participants to allergens, insects, feed, or naturally occurring bacteria. I agree to follow posted rules and staff instructions on animal interactions and voluntarily assume these risks.

Certain attractions — including the Apple Cannons, Pumpkin Cannons, Paintball Target Gallery, Excavation Station, Pumpkin Lane Train, Wagon Rides, and Zipline — involve mechanical equipment, moving rides, or projectiles. Cannons and the Paintball Gallery are designed to fire only toward designated target areas under staff supervision. Participants must stay within designated areas and follow staff instructions; failure to comply may result in removal without refund.

I grant Gull Meadow Farms the unrestricted, perpetual, worldwide, royalty-free right to photograph, film, record, or otherwise capture my image, likeness, voice, or appearance while on the premises — and, if applicable, on behalf of any minor I'm signing for. I authorize GMF to use this media for advertising, marketing, social media, websites, and other lawful business purposes without additional notice or compensation, and I waive any right to inspect, approve, or be paid for its use.

GMF staff are not medical professionals and aren't expected to provide medical care. In an emergency, GMF may contact emergency services or otherwise assist. I authorize emergency treatment if I'm unable to consent and no authorized representative is available, and I understand I'm solely responsible for any resulting medical expenses.

I'm responsible for safeguarding my own personal property. To the fullest extent permitted by law, GMF is not responsible for lost, stolen, or damaged property, including vehicles, belongings, electronics, strollers, or wheelchairs brought onto the premises.

This Agreement is governed by Michigan law, with any legal action brought exclusively in a state or federal court serving Kalamazoo County, Michigan. If any provision is found invalid or unenforceable, it will be modified or severed while the rest of the Agreement remains in effect. This is the entire agreement between the Participant and GMF on this subject, superseding prior agreements; changes must be made in writing by GMF.

My electronic signature carries the same legal force as a handwritten one. By signing, I certify my information is accurate and that I intend to be legally bound — and if signing for a minor, that I have the authority to do so.

By signing, I acknowledge that I've had the opportunity to read this Agreement fully and ask questions, that I understand the rights I'm giving up, that participation involves inherent risks I can't fully avoid, and that I'm choosing to participate anyway. This Agreement is intended to be as broad as permitted under Michigan law and applies to this visit and any future visits, unless GMF publishes a revised version.
